Assistant General Counsel, Immigration Service
Candidate will provide expert and comprehensive employment-based immigration advice and assistance to college’s departments and international employees. File applications with the US Dept of Labor and USCIS on behalf of college. Stay current on complex federal rules and regulations. Conduct legal research, prepare legal opinions, and provide legal advice related to CGE immigration and exchange policies and practices, and applications submitted by department. Review all college’s international agreements with partner universities for legal form and sufficiency. Advise departments and employees on regulations, documentation, and procedures related to the H-1B, J-1, TN, E-3, O-1, etc. visa options. Prepare and submit H-1B and other petitions to USCIS on behalf of college. Evaluate applications, prepare or request prevailing wage determinations, evaluate actual wage information, initiate postings, create and submit Labor Condition Applications, and provide notice to employees. Sign applications on behalf of college. Conduct one-on-one meetings with new employees and hold workshops with departments. Assist in advising faculty, departments, and new employees on the process and paperwork required for the university to sponsor permanent employees for an immigrant visa (green card). Gather documentation and prepare and process labor certifications and EB1 Outstanding Professor/Researcher petitions filed with the US Dept. of Labor and USCIS by college. Assist employees with applications for immigrant visa as appropriate. Maintain CGE records for each application. Maintain case files and records in compliance with federal regulations. Track cases and maintain electronic copies. Close files when appropriate. Prepare and maintain public inspection files and documentation required by the U.S. Department of Labor. Gather data and create reports as needed, such as the annual Open Doors Scholar report. Conduct legal research, provide legal opinions, and render legal advice related to employment-based applications, application of regulations and guidance related to international faculty, staff, Exchange Visitors and international students. Evaluate, review and approve for legal form and sufficiency Memorandums of Understanding with partner universities and exchange agreements. Consult and coordinate legal advice with the Office of the General Counsel as appropriate. Work closely with Human Resources to ensure that processes are consistent with college’s HR practices. Request HR Assistance and review for questions related to wages or recruiting. Review electronic personnel action forms submitted by departments for H-1B employees and J-1 employees and students, to verify that requests are consistent with Department of Labor requirements. Identify changes that require amended or updated immigration applications, and verify that J-1 students have appropriate work authorization. Approve, deny, or push back electronic personnel action forms as appropriate. Participate in CGE programs and events. Serve on campus or Division committees as appropriate. Participate in professional organizations, listservs. Conduct presentations and training workshops. Perform other duties as necessary. Will report directly to the Associate Director, Immigration Services.
