Attorney Associate
Duties: Under the supervision of the Director, assists the students of the University at the campus with various legal problems and concerns in a confidential and professional manner. Handles both civil and criminal matters, such as landlord/tenant disputes, family law, criminal defense, and consumer debt collection. Interviewing new clients, providing legal counsel/advice, evaluating the merit of claims, and providing representation in litigation when necessary. As part of their representation of student clients, an attorney associate researches and drafts legal documents including complaints, answers to complaints, motions, legal briefs, mediation summaries, and judgments. Memoranda regarding specific legal opinions may be required. May specialize in one or more areas of the law as the office needs dictate, but is expected to have a general knowledge of a broad spectrum of legal issues. Conduct intake interviews each week. Provide legal advice on matters including consumer disputes, landlord-tenant disputes, criminal cases, and collection matters. Negotiate on client's behalf as necessary, including phone calls and correspondence. Monitor and provide follow up advice as necessary. Encourage self-help and alternative dispute resolution whenever possible. Refer cases as appropriate to university or community resources. Civil Litigation: Evaluate cases to determine if appropriate for litigation. Review selected cases for complex litigation. File pleadings, conduct discovery, investigation, and attend pre-trial matters such as mediation and motions. Engage in settlement negotiations and provide representation at trial as needed. With the director's approval, prepare appeals to circuit court or court of appeals, and argue appellate briefs. Domestic Relations: Evaluate cases for divorce or other family law litigation. File complaints or personal protection order motions or defenses, as may be appropriate. Conduct discovery, investigation, pre-trial matters such as Friend of Court intervention and motions. Engage in settlement negotiations and provide representation at trial as needed. Criminal Law: Advise and defend clients charged with misdemeanors or felonies by either the City of Ann Arbor or the State of Michigan (through the Washtenaw County Prosecutor). Conduct discovery, investigation, and attend pre-trial matters including motions. Engage in plea and sentence negotiations, and provide representation at trial as needed. Community Involvement and Continuing Education: Accept speaking and teaching engagements throughout the university community. Provide representation on community and university boards and organizations. With approval, initiate projects to benefit the education of the university student community.
