Forest Laboratories & Forest Pharmaceuticals Sued

Sanford Heisler, LLP, announced on November 5 that they are assigning six extra female plaintiffs to the $100 million gender discrimination employment class suit they originally ordered three months ago against Forest Laboratories, Inc., and Forest Pharmaceuticals, Inc., of New York, according to Equities.com.

The altered grievance was ordered in the federal courts in New York for the Southern District on the morning of November 5.  It raises the total of plaintiffs to ten and issues backing to the allegation that Forest treats female workers differently from across the nation.

The freshly named plaintiffs are all current Forest sales associates or former reps who excelled at a higher level.  They include Kimberly Clinton and Maria Avila of Los Angeles, Erin Eckenrode of York, PA, Julie Smyth of Lebanon, PA, Andrea Harley of Louisville, KY and Christy Louder of Girard, IL.  The primary plaintiffs are Megan Barrett of Pennsylvania and Lindsey Houser, Jennifer Seard and Jennifer Jones from Texas.

The initial and altered complaints insist that the female sales associates in the past and current are compensated on a lesser scale than equally able male employees, in lieu of admirable production in the workplace from the female gender.  Because of it, all plaintiffs were spurned promotions, stock options, commissions and other worker bonuses.

The dispute filed boosts extra proof regarding Forest’s continuous trends of discrimination of harassment of expecting sales associates and female sales personnel who care for their sick children.  It also exhibits evidence of the plaintiffs’ beliefs that Forest neglects and diminishes proof of gender discrimination across the country.

“We do not know whether Forest does not have or does not choose to follow the gender neutral policies, practices and procedures that are required by federal and state laws,” said Katherine Leong, a member of the litigation team at Sanford Heisler. “We also do not know why – when Forest is provided repeatedly with information that pregnant women and mothers are among those most severely harassed and discriminated against — that this giant company consistently ignores these reports and punishes the women who make them. What we do know is that this gender harassment and discrimination have already persisted too long and must be brought to an end.”

The fixed complaint from the secondary plaintiffs exhibits the same viewpoints of the primary plaintiffs:  When females claimed discrimination and harassment by the male workers and told their supervisors or Forest’s human resource department, they countered their claim and multiple people lost their jobs.  No corrective action was taken against the males.

Forest Laboratories is a universally recognized organization that evolves and markets prescription and non-prescription pharmaceutical products all over the nation.  On October 16, Forest predicted a $3.2 billion revenue stream for 2013.

The complaint desires a judgment that Forest has taken part in systemic gender discrimination, a declarative prohibition against repeated discrimination and a restructuring of several Forest policies so females can be on a level playing field for circumstances of employment that have normally benefited males.

It also moves for Forest to push female workers into more well-compensated positions they would have earned if not for Forest’s discrimination.
