Administrative Law Judge
The candidate, under the direction of the Board Executive Secretary, Board Members and Supervising Administrative Law Judge (ALJ), presides over quasi-judicial hearings concerning representation issues, unfair labor practice charges and other issues under the jurisdiction of the Agricultural Labor Relations Act. Serves as the ALJ for the agency's hearings which include complex, difficult, sensitive quasi-judicial hearings concerning unfair labor practice charges, representation matters, and other issues under the jurisdiction of the Agricultural Labor Relations Act. Administers the oath and explains the hearing process to witnesses, listens to testimony, rules on objections to questions and the introduction of evidence, makes inquiries to evidence presented, maintains order in the hearing room, sets and manages the hearing schedule, and directs the attorneys and parties how to proceed. Responsible for making witness credibility determinations, conducts legal research, and provides direction to the court reporter and interpreter. Incumbent reviews hearing transcripts and legal briefs filed by the attorneys and/or parties. Incumbent renders a detailed written decision containing findings of facts, conclusions of law and recommended dispositions based upon applicable precedent under the Agricultural Labor Relations Act and the National Labor Relations Act. Presides over prehearing conferences and case management conferences. Rules on disputes regarding subpoenas and other discovery matters. The prehearing conferences may be conducted either in person or telephonically. Conducts case settlement conferences and reviews parties' electronic filings with the ALRB to determine if the filings comply with ALRB requirements. Assists the Executive Secretary or Supervising ALJ in preparing daily reports and media to the Labor Workforce Development Agency. Assists with agency annual reports.
