In-House Counsel
The candidate will be responsible for: Provide legal support services to central and field property management and operational teams. Provide legal guidance to property management teams in local markets across the country regarding various property management, fair housing, maintenance, and customer service-related issues (Legal Help Desk). Negotiate and draft lease termination and settlement agreements for use by local property management teams in working with residents. Negotiate and resolve or coordinate with outside counsel and insurance adjusters regarding claims or litigation matters such as small claims security deposit disputes, maintenance issues, vendor disputes, personal injury claims, and HOA disputes. Respond to consumer complaints directed to state regulatory or consumer protection agencies. Provide legal guidance and oversight regarding real estate licensure and compliance. Provide legal guidance regarding development, management, and HOA issues related to new build-to-rent communities. Advise leadership regarding compliance issues related to operational initiatives. Conduct multi-state research surveys regarding various aspects of real property and landlord/tenant law and analyze operational impact of same. Draft, review, and negotiate a variety of contracts including with third-party vendors and commercial leases. Draft and review internal company policy. Must have Juris Doctorate Degree from a top-tier law school with commensurate academic performance. Should have an active license to practice law in at least one state. Must have 5+ years of legal experience, with some litigation experience. Specific experience with residential landlord/tenant law and evictions, real estate, contract law, premises liability, and/or HOAs highly preferred. Law firm experience preferred.
