IT Contracts Attorney (WMS 2/DLS)
The candidate should have advanced knowledge of contracts law and experience drafting business and contractual documents, ranging from standard contracts and amendments to complex, high-dollar-value transactions. Provides the planning, expert consultation, and advice to assure the effective negotiation, establishment, and ongoing contract administration in support of ProviderOne and other major IT procurements. This position uses expert knowledge of contracting law including regulations governing the solicitation and acquisition of IT services, multiparty contracts, and vendor contract management to develop acquisition documents and contracts, to negotiate terms favorable to the state and to effectively resolve any issues or disputes. Provides the planning, legal consultation, and advice to assure the effective negotiation, establishment, and ongoing contract administration in support of the ProviderOne system. This position negotiates agreements; manages legal services provided by others, e.g. various Assistant Attorneys General (AAG) and the Special AAG; and advises agency staff on legal issues that arise in the areas of: intellectual property; software licensing, ownership and ASP models; security and privacy; hardware and software procurement; business law; health care law and Medicaid rules and regulations; and coordinates with staff of the Attorney General’s Office. This position independently initiates, manages, and completes complex HCA contracts and procurements by coordinating with ProviderOne stakeholders and internal program staff in accordance with RCW 39.26, 43.105, 43.19, 74.09, 42.52 and other pertinent statutes. It also manages and facilitates protest debriefings with non-successful bidders. Develops the work plan for competitive contract solicitations related to HCA’s MMIS/ProviderOne system and any related IT systems for the Medicaid program. Independently writes and/or provides technical advice for the Scope of Work and other procurement documents for ProviderOne staff using best practices and in compliance with state and agency policies. Research laws, rules, policies, and procedures related to the development and execution of MMIS-related procurements and technology including the interpretation of published federal or state rules or requirements to accurately advise agency staff in coordination with its assigned Assistant Attorney General.
