Compliance Privacy Specialist - Integrity and Compliance
The candidate will perform varied advanced HIPAA Privacy Compliance, General Compliance, and Administrative duties which requires knowledge of applicable Federal and State rules, laws and regulations, accreditation standards, and internal policies and procedures. To provide support to the Privacy Officer in managing risk, fostering compliant behavior and embraces firm mission and goals. This includes: negotiating terms of Privacy and/or Compliance documents, performing regulatory research, developing and distributing timely and relevant UMMC Compliance communications and education, developing policies and procedures, conducting privacy audits and/or investigations, and responding to questions or concerns, from both internal and external customers, as needed. Other duties: Drafts, redlines, negotiates and finalizes Compliance and/or Privacy contracts/documents, including but not limited to Business Associate Agreements and/or Data Use Agreements, under the direction of the Privacy Officer and with minimal oversight; Anticipates contracting issues and initiates appropriate actions to ensure contract documents are processed efficiently and in accordance with applicable laws, rules and regulations along with UMMC policies and guidelines; Stays abreast of applicable healthcare laws, rules and regulations, including but not limited to HIPAA, FERPA, Substance Abuse and Mental Health confidentiality regulations, Stark, Anti-kickback, and those related to Fraud/Abuse; Determines the impact of applicable healthcare laws rules and regulations in order to provide guidance as applicable to lower compliance risks to UMMC; Helps to reduce compliance risks to UMMC by identifying and effectively communicating potential compliance issues to management and resolving the issues or assisting management in resolving the issues; Develops and maintains solid working relationships with internal (i.e. other compliance staff/co-workers, physicians, administrators, legal counsel, etc.) and external customers; Compiles and presents compliance data, including statistical data, to committees, leadership, etc., as needed or requested; Presents compliance related material and/or information in a professional manner to ensure understanding of content and urgency of the message; Assists as needed with compliance educational efforts including development and presentation of training materials; Coordinates compliance related improvement activities including corrective action plans in collaboration with UMMC Leadership, departments, and other UMMC affiliates when appropriate; Handles multiple tasks and priorities in a changing business environment.; Conducts research on legal issues or other topics as required. Participates on special project teams. Bachelor's degree in Legal Studies, Paralegal Studies, Healthcare Law, or related field and and 3 years of compliance/legal/privacy experience in a health care setting required. Masters or Juris Doctor strongly preferred. Certification in Health Care Compliance and/or Privacy as CHC or CHPC through HCCA, or CIPP, CIPM, CIPT through IAPP, or CPCO through AAPC, or CHPS through AHIMA strongly preferred. Strong research and communication skills, including the ability to take complex information and present in a clear and concise manner required. Ability to maintains current knowledge of applicable Federal and State privacy laws and regulations, to include a working knowledge of the HIPAA Privacy and Security Rule, FERPA, Substance Abuse and Mental Health confidentiality regulations, and Stark needed. Ability to interpret Federal and State regulations and communicate impact to applicable stakeholders required. Proficient communication skills and ability to develop, maintain and strengthen collaborative relationships with both internal and external stakeholders needed. Ability to be flexible and adapt to new information, changing conditions, unexpected obstacles and/or changes in policies and processes required. Ability to handle the demands of new tasks/assignments/projects, along with other routine responsibilities needed. Advanced skills with Microsoft applications which may include Outlook, Word, Excel, PowerPoint or Access and other web-based applications required. May produce complex documents, perform analysis and maintain databases. Ability to negotiate with departments, customers, and vendors regarding Compliance and/or Privacy requirements within contracts/documents needed. Detail orientated, able to do problem solving and thorough problem analysis needed. Organization, facilitation, communication, and presentation skills required. Ability to ensure compliance with established UMMC standards and policies needed. Ability to establish priorities, work independently, and proceed with objectives through completion needed.
