Regulatory Affairs Paralegal
The candidate will assists in the regulatory compliance function by performing research and support activities relating to various legal and regulatory issues, including scope of practice issues, privacy laws (to include HIPAA, HITECH and state laws), pharmacy laws and regulations, state and federal open records acts, correctional health care, minority business enterprises, and other federal and state laws and regulations. B.S. or B.A. preferred; or related experience. 2 years’ experience as a paralegal, preferably in health care and privacy fields. Excellent research and writing skills required. Paralegal certificate preferred. Perform research and support activities relating to various legal and regulatory issues, including scope of practice issues, privacy laws (to include HIPAA, HITECH and state laws), pharmacy laws and regulations, state and federal open records acts, correctional health care, minority business enterprises, and other federal and state laws and regulations. Draft memoranda summarizing results of research and provide to supervisors and/or clients. Assist in maintaining records of items monitored or controlled by the regulatory team. Analyzing and interpreting subpoenas and HIPAA authorizations. Provide timely, well-written and accurate responses to requests for assistance with regulatory matters, including guidance to operational staff regarding the handling of requests for patient records and, when required, written responses to attorneys and individuals who are requesting records. Assist in maintaining records, and submitting filings in connection with various state and federal regulatory requirements. Understand and comply with all relevant federal and state laws and regulations, and assist company in addressing regulatory and legislative changes. Prepare initial draft of requests for various state attorney general opinions related to regulatory matters. Draft memoranda summarizing results of research and provide to supervisors and/or internal clients. Conduct HIPAA Incident and Breach Risk Assessments in conjunction with field staff and counsel. Monitor communications with various outside entities regarding medical care at various locations. Communicate and correspond with clients, attorneys and agencies. Must be able to apply principles of critical thinking to a variety of practical and emergent situations and accurately follow standardized procedures that may call for deviations. Must be able to apply sound judgment beyond a specific set of instructions and apply knowledge to different factual situations. Must be alert at all times; pay close attention to details. Must be able to work under stress on a regular or continuous basis.
