Senior Director, National Litigation
The candidate will be developing and overseeing a litigation program for ADL, significantly augmenting the advocacy tools we already have in place for countering antisemitism, fighting domestic extremism and combating online hate. The Senior Director will be responsible for building and implementing a strategic plan for litigation at ADL and for the marshaling and oversight of the necessary resources, including lawyers. Those legal resources will include staff lawyers with litigation experience, law firms willing to donate pro bono time, and volunteer ADL leaders across the country who are attorneys. The Senior Director will be able to draw upon ADL’s experts on antisemitism, extremism, and online hate research; our in-house government relations and advocacy department; an existing civil rights policy team of experienced counsel; and 25 ADL offices across the U.S., with their own contacts. The expectation is that ADL litigation will largely be handled by pro bono firms and state agencies (e.g., State Attorney General offices) with whom we will partner, where the Senior Director or other ADL lawyers serve as active co-counsel. We also frequently partner with public interest civil rights and democracy protection organizations. The hope as we move forward with a new program is to find a small but impactful number of cases and to litigate them with, and through, our legal partners. Develop and run a strategic litigation program best suited to ADL and the furtherance of its priorities, creating and executing upon a plan to yield a near-term docket and a longer-term litigation program and pipeline for cases. Leverage ADL’s assets (reputation, regional offices, volunteer lawyer lay leaders across the country, deep subject matter expertise, law firms eager for pro bono work, etc.) to develop and execute the ADL litigation program. Further develop and nurture ADL’s existing network of volunteer leaders and law firms that can provide pro bono representation as co-counsel with us. Develop criteria and a process for choosing litigation. Play a key role in promoting ADL’s ability to litigate to key stakeholders, including but not limited to promoting ADL as the “go-to” organization for municipalities that experience a violent extremist event. Work across the organization to leverage ADL’s communications, field (regional) offices, education, law enforcement, market reform and legislative teams to amplify the goals of the litigation. Provide strategic litigation advice and guidance to senior leadership, ADL’s civil rights and policy staff, and ADL’s regional offices across the United States, particularly on issues related to antisemitism, online hate and domestic extremism. Prepare and deliver presentations about ADL litigation on antisemitism, extremism, online hate and harassment and threats to democracy to a wide variety of audiences. Respond, as appropriate, to legal inquiries from internal and external sources, including other ADL staff, volunteer leaders, constituents, coalition partners, and government officials. Assist in preparation of grant applications and grant reports for foundations and other funders. Highly effective interpersonal, communications, and public speaking skills. Highly collaborative--actively seeks the ideas, feedback, and participation of colleagues and can lead a matrixed team across different ADL departments and teams. Can thrive and lead in a fast-paced environment. Ability to create and implement a strategic plan for impact litigation to further ADL’s mission and priorities. Substantial and demonstrable experience creating/managing/driving litigation/litigation programs relevant to the type of program ADL seeks to create. Entrepreneurial leader with experience developing and implementing a successful strategy for impact litigation. Demonstrated experience or interest in a relevant field of public interest law, such as civil rights, preferred. Successful development of, or a leadership position in, a litigation shop -- such as leading a law firm’s pro bono practice or building a litigation unit or practice in a civil rights or similar nonprofit, preferred. J.D. degree required.
