Data Privacy & Cybersecurity Associate
The candidate requires a keen interest in the intersection of emerging technologies and data privacy/cybersecurity law, coupled with a desire to work collaboratively to deliver thought leadership and best-in-class service to clients. The primary focus will be advising clients in the implementation of cybersecurity and privacy compliance programs, breach response, regulatory investigation and litigation management, technology transactions, and M&A due diligence. Will support, develop, and help lead all phases of the practice group’s work. Contribute to the ongoing development and implementation of the team’s strategic plan. Participate in new client development and marketing activities, including both internal and external writings and presentations on emergent industry trends and development of best practices. Lead clients in the implementation of data privacy and cybersecurity programs. Support clients in responding to cybersecurity incidents and data breaches. Lend subject matter support on mergers and acquisitions, including data privacy and cybersecurity due diligence, from pre-deal through post-closing. Negotiate agreements related to data privacy, data sharing, and information security, as well as technology agreements related to cloud, XaaS, IT outsourcing, and software license arrangements. Advise clients on data privacy and security laws, including CCPA, GDPR, HIPAA, GLBA, ECPA, NYDFS, consumer protection, and similar state laws and regulations. Evaluate state and federal breach response and breach notification requirements. Make recommendations on related compliance regimes, enforcement trends, and pending laws and other legislative developments. Perform other related duties.
