Franchise Attorney
The candidate will be responsible for managing all legal issues that might impact franchise system, including but not limited to following all USA franchisees registration protocols, manage the franchise disclosure documentation required by the Federal Trade Commission, and create, draft, and review all contracts negotiated. Support SR. level executives board with advising on legal, finical, and HR matters. Update and advise management on the status of litigation, claims, and other significant legal matters. Assist in developing and driving litigation strategy for franchises in North America. Drafting franchise and Multi Unit Operator Agreements. Draft legal documents/amendments. Coordinate with SR. Level executives and internal experts on franchising, intellectual property, data privacy, marketing, HR, and other matters. Develop and maintain a library of forms of commercial and technology related legal documents, ensuring they reflect best practices and appropriate legal requirements. Have and develop personal relationships with local lawyers, officials, and work with local legal counsel. Help the franchisor develop its relationships with an overseas partner and ensure that all agreements comply with the laws of the host country. Review contracts and redline accordingly. Franchise Disclosure Document (FDD) reviews and modifying to have outside counsel update. Stay apprised of applicable privacy related laws and regulations. Protect the franchisor’s confidential information and trade agreements. Should have 4-7 years of legal experience. Should have 2+ years of relevant experience in franchise law. Experience relevant to Quick service restaurant/ hotel/hospitality/franchise industries (legal or business experience). Excellent communication (verbal and written), drafting and negotiating skills. Strong business acumen, problem solving skills and legal judgment. Must have exceptional customer focus and approachability. Should have JD degree. Should have passed New York State Bar Exam.
