Associate Data Privacy Counsel
The candidate will handle a wide variety of data protection and privacy issues and working closely with multiple other cross-functional stakeholder groups, including Information Security, Engineering, Marketing, Sales, Human Resources, and Product teams to provide legal advice and day in and day out support of existing and new products and services. Negotiate privacy provisions in contracts (vendor and customer side), provide product counseling, and play a hands-on role in continuing to build out a best in class internal data privacy compliance program. Administer privacy risk assessments, help keep “data inventory” up to date, and support remediation plans in conjunction with the company’s Information Security Department and other business stakeholders. Perform privacy reviews of new and innovative tools and technologies. Proactively implement changes to processes and procedures in anticipation of regulatory and business developments. Conduct legal analysis of the application of international (e.g, GDPR), federal and state privacy laws and regulations as applied to the company's business lines and subsidiaries and identify related compliance issues. Support the maintenance and continued maturation of the company’s Data Privacy & Compliance Program, including drafting and updating corporate policies, operational controls, and business processes. Monitor and provide advice on implementation of new privacy and security laws and regulations impacting the company's business. Respond to internal and external privacy inquiries, including Data Subject Requests. Provide day-to-day privacy and data protection advice to internal business units, including Marketing, Data Analytics and Product Development. Draft and negotiate contractual privacy terms and conditions. Juris Doctorate degree from an ABA accredited law school with outstanding academic credentials and member of a state Bar in good standing is required. Should have 2-4 years’ relevant and applicable privacy experience at a law firm and/or in house legal department. Experience negotiating data processing agreements (vendor and customer side), and data protection provisions in broader commercial, licensing and service agreements is required. In-depth understanding of data privacy regulations, including GDPR, CCPA/CPRA, Can-Spam, PIPEDA, etc. is required. CIPP/US and/or CIPP/CIPM certification is strongly preferred.
