Senior Counsel – Cybersecurity

The candidate will assist with legal reviews and analysis related to the NYDFS Cybersecurity Rule, the NAIC Model Data Security Law, and other applicable laws and regulations. Assist with compliance programs regarding applicable privacy, information security and data use laws. Negotiate and draft contractual provisions related to privacy and information security requirements. Help coordinate incident response activities with the Information Security Team and Financial Crimes Unit. Translate complex laws and regulations into technical and operational legal requirements, and oversee the implementation of those requirements by the Information Security and Technology teams. Provide support and oversight for reporting metrics for the PIM team which includes quarterly and monthly reporting on information security incidents and other PIM team activities. Work on complex legal issues where analysis of legal business matters requires an evaluation of various factors and exercises judgment commensurate with experience. Review pre-existing documents and templates within assigned practice area(s). Provide a variety of general legal services to a number of in-house constituents, primarily within the legal and compliance department, but will work with business partners with oversight under supervision of more senior attorney with moderate discretion to make independent decisions within predefined guidelines. Confer with business areas as directed. Participate in departmental and cross-functional working groups as directed. Examples of work: Select from pre-approved, options in template contracts; conduct legal research for more senior attorney; assist in responding to discovery requests; review and approve certain customer correspondence (e.g., letters, advertising). Assist with data use case reviews. Should have a JD from an ABA accredited law school. Must have 5 years of relevant legal experience. Licensed or eligible to practice in the applicable state. Ability to effectively communicate, both written and oral, with the intended audience. Ability to exercise sound judgment in a fast paced environment. Ability to exercise agility and adaptability in providing legal advice. Comfortable in a rapidly changing corporate environment. Proficient using MS Office. Proficient using Powerpoint and creating slide decks for senior management. Some familiarity with privacy and security laws, including GLBA, FCRA, HIPAA, state data breach laws, etc. Experience with technology transactions. Experience with security events.
