Job Description:

Position Purpose

Where you fit in?

The successful candidate will be an integral part of the Information, Governance and e-Discovery (IGD) team within Global Litigation. This litigation role will focus primarily on Group-wide efforts to identify, preserve, harvest, and produce electronically stored information (“ESI”) in the context of litigation, investigations (both civil and criminal), regulatory and other legal matters that may arise. This attorney will work with in-house and outside counsel to develop and implement efficient and cost-effective discovery strategies and advise IT and business colleagues on strategies to mitigate legal risks associated with discovery obligations. This attorney will help identify potential e-discovery problem areas for Shell attorneys and paralegals, external counsel, and clients and translate them into legally sound, and easy-to-understand solutions.

What’s the role?

This position is in Houston and will report to the Managing Counsel - LIG in Global Litigation. You will work directly with the Global Litigation team and legal overall on specific matters and issues. This responsibility extends to assessing value versus risk in developing and implementing best practices around e-discovery, preservation and cross-border discovery, and providing expertise and advice on substantive preservation, e-discovery and records management issues to Shell attorneys and legal staff handling Shell litigation, investigative, regulatory and other proceedings. This position will interface with Group Records Management, Global IT, as well as Shell business personnel, external counsel, contractors and vendors.

Advise internal and external counsel on legal requirements for identification, preservation, and collection protocols in connection with litigation and regulatory matters.

Advise IT, HR and business communities on legal preservation and e-discovery requirements.

Develop recommended discovery strategies designed to support overall legal and case strategies.

Develop effective data culling / filtering strategies through search term calibration processes, data analytics, and TAR.

Support document review projects and monitor regular productivity metrics regarding the work of the review lawyers.

Remain apprised of case law and litigation technology developments in electronic discovery and document review.

Ensure that legal considerations, including mitigation of legal risks identified, are considered in operations, planning activities, and relations with relevant third parties.

Propose strategies and provide legal support that enable safe, efficient, value-added and agile decisions to secure competitive advantages.

Protect Shell's interests and enhance Shell's reputation and brand by providing sound legal advice.

Establish and manage of global e-discovery best-practices.

Assure alignment throughout the Shell organization, including with IT, Legal, and the Business communities, with respect to preservation and e-discovery issues.

Skills & Requirements

What we need from you -

Must have legal authorization to work in the US on a full-time basis for anyone other than current employer.

Law degree from U.S. accredited institution

Minimum five (5) years’ experience as a Licensed Litigation Attorney in good standing in Texas or another state in the United States (or ability to become immediately eligible to be admitted to the State Bar of Texas).

Three (3) years’ experience handling litigation matters, from inception to close, including managing discovery in the U.S.

“Front line” discovery experience generally, and specifically concerning e-discovery. Good knowledge of the applicable rules of procedure and evidence governing discovery and Data Privacy/Cross border discovery.

Basic knowledge of Information technology (IT), including IT terminology, IT processes, commonly used IT systems and applications associated with litigation generally, and e-discovery specifically, as well as the extraction, production, and processing of electronically stored information, including metadata.

Basic knowledge of database concepts, data modeling and database applications and application of such knowledge in a variety of situations.

Ability to convey the meaning and importance of legal requirements pertaining to discovery obligations to IT personnel, Legal colleagues and business personnel. Ability to explain procedures, time periods, difficulties, and related costs and expenses of e-discovery processes.

Knowledge of Relativity or other similar e-discovery tools.

Ability to provide training to internal and external counsel on the use of databases and tools.

Good overall knowledge of information security concepts and an understanding of their dependencies

Demonstrated experience managing multiple, concurrent projects involving cross-functional teams within budgetary and schedule constraints.

Capable of communicating effectively with the team regarding case status and upcoming needs.

Proven ability to manage and minimize potential exposure to legal sanctions and fraud concerning discovery, particularly as related to high-risk dockets.

Agility to respond to changes in requirements mandated by regulatory agencies, evidentiary rules and court rulings.

Ability to plan, schedule and monitor work, within set targets, for several matters.
