Paralegal/Claims Examiner
Duties: Will handle all claims discovery of all litigated claims generally 15-20 litigated claims annually. Will also handle their own claim cases, which may include injury, property damage or cargo claims, based on capacity and number of litigated file for the department. Responsible for the actual departmental litigated claim discoveries. Responsible for own selected claims to analysis and manage complex first and third party liability, property damage, injury, and cargo claims. Review, investigate, and make decisions regarding coverage, compensability, and appropriateness of claims. Will process and document claims to ensure compliance with company standards and industry best practices. Negotiates claim settlements and manages subrogation if necessary. Conduct the handling of claims in the utmost of good faith in compliance with the rules, regulations and company core values. Expected to function with a high degree of competency, the use of good judgment coupled with consistent results. Manage litigated & non-litigated claims, and process 3rd party liability and cargo claims by investigating and gathering information to determine the exposure of the claim. Negotiate settlement of claims and make claim payments from $20,000 to $30,000 without management approval and obtains management approval for claims exceeding authority level. Process complex or technically moderate or difficult injury and cargo claims. Complete bodily injury and litigation reporting timely. Calculate and assign timely and appropriate reserves to claims and continue to manage reserve adequacy throughout the life of the claim. Develop and manage claims through well-developed action plans; continue to work the action plan to bring the claim to an appropriate and timely resolution. Actively assist in managing the litigation process; ensure timely and cost-effective claims resolution. Coordinate vendor referrals for additional investigation and/or litigation management. Use appropriate cost containment techniques including strategic vendor partnerships to reduce overall cost of claims. Manage claim recoveries of all types, including but not limited to subrogation. Report claims to the excess carrier, responds to requests of directions in a professional and timely manner. Frequently communicates with all appropriate parties involved with the claim. Refer cases as appropriate to management. Actively executes appropriate claim activities to ensure consistent delivery of quality claims service. Coordinate investigations with independent adjusters, attorneys and experts. Work within set company and DOT guidelines to determine when post-accident drug and alcohol testing are needed and notify the Safety department. Effectively communicate with internal departments and notify them of accidents and/or injuries, as required. Participate in rotating schedule for on call after hour’s coverage. Maintain accurate files entering timely documentation for each claim. Provide coverage for the claims examiners’ team as necessary. Coordinate the routing of drivers and/or equipment for litigation related activities. Coordinate associates, experts, witnesses and others for trial related activities. Perform investigative functions as directed. Review legal bills for reasonableness, approve for payment, and request checks. Complete and update legal department projects. Perform Notary Public duties for the department. Assist other Claim Examiners with questions. Perform other duties and assumes other responsibilities as assigned.
