Legal, Commercial Services Counsel
The candidate will coordinate, manage and assist with underwriting national complex, high liability commercial real estate transactions ranging from single site to multi-site transactions. Will require assistance with title clearance and satisfaction of commitment Schedule B-I requirements, providing resolution of title comments/objection letters, reviewing title/survey comments and underwriting requests. Negotiation of endorsement/affirmative coverages with multiple underwriters and regional offices. Assists associates with the legal aspects of title and closing issues. Maintains confidentiality. Refers to company's other Senior Underwriting Counsel for consultation. Review of Title searches and surveys. Resolution of Title defects and curative matters. Prepare commitments and policies. Obtain and maintain title license in states where the company is licensed. Required to sign/issue commitments and policies, upon appropriate state licensure. Determine service needs, answer questions, update status, explain processes and requirements. Work with attorneys, customers, lenders, high level principals, insurers in connection with issuance of title commitments and policies on complex commercial transactions. Negotiation of coverages with Underwriters on behalf of the client. Handling of escrow. Preparation and review of settlement statements. Assist Division counsel and General Counsel with any Underwriter, Escrow and title compliance matters. Assist Division Director with reports and financial reporting requirements. Responds to claim problems and advises the title or escrow officers involved. May need to Interact with the Dept. of Insurance on regulatory matters. Stays current and distributes to staff information regarding new laws and procedures. Other duties and responsibilities as assigned by supervisor. Must have a J.D. Degree from an ABA accredited law school and admission to actively practice law as a member in good standing in at least one state. Must be willing and able to obtain title licenses in multiple states. Experience in a national commercial title or closing environment is preferred. Must have strong understanding of fundamental concepts, practices and procedures of real estate law/practices, title insurance and settlement process. Must have general understanding of underwriting real estate transactions for the issuance of title insurance policies. Must have general knowledge of Federal and State regulations related to real estate title insurance and settlement services. Must have a strong work ethic and the desire to achieve excellence in customer satisfaction. Proficiency in Word, Excel, Outlook and with the willingness to embrace technology applications is required. Juris doctorate degree required. Continuing legal education requirements. Member of Bar Association and license to practice law in assigned state. Title license in at least one US state is preferred.
