The Vanderbilt University Medical Center Office of Legal Affairs is looking for an exceptional individual with 5+ years of experience counseling healthcare clients on all aspects of hospital operations to join its team. This individual will report to the General Counsel and Secretary of Vanderbilt University Medical Center.
The ideal attorney will possess the following:
5+ years of advising healthcare providers on an array of healthcare operations matters, including patient care issues, privacy and security matters, compliance with anti-kickback and fraud and abuse regulatory requirements;
Experience analyzing and advising on regulatory requirements and guidance and translating that information into institutional policy and/or actionable guidance;
Experience in general healthcare regulatory and operational issues;
· Experience in advising on adult, pediatric and behavioral health patient related matters such as treatment, refusal and consent to treatment issues;
· Experience in advising on consent to treat and other issues in care delivery, including surrogate decision making, guardianships, conservatorships, and involuntary hospitalization.
· Experience in advising on end of life issues, ethical and legal conflicts between patients, families and healthcare providers;
· Experience in advising on child and adult abuse issues;
· Experience in drafting and reviewing contracts in the healthcare setting;
· Experience in policy review and drafting, as well as educating health care providers on policy compliance;
· Knowledge of state, federal and other agencies’ requirements for medical records, and the ability to understand and navigate the VUMC EHR;
· Ability to collaborate with stakeholders to educate, advise and evaluate regulatory risks;
· Significant experience working in-house or as outside counsel working closely with healthcare clients;
· Effective communicator, comfortable working with individuals at all levels of the organization;
· Experience with data privacy in a research setting a plus;
· Experience in identifying and managing protected health information breach, including investigation of the breach, patient notification and breach reporting;
· Experience responding to requests for protected health information from third parties, including government agencies, law enforcement, payors, providers, attorneys, etc.;
· Willingness to attend and be an active participant in and advisor to multiple hospital and medical center committees;
· Excellent academic credentials and related experience;
· State bar admission and Tennessee bar admission within 1 year;
· A proactive nature, problem solver and “can-do” attitude;
· Ability to work independently and be pragmatic and results focused;
A good sense of humor, desire to tackle new challenges and be part of an incredible team.
· Additional experience working with electronic health record incentive programs, employee benefit plan experience, understanding of and collaboration with risk management, regulatory compliance or supply chain contracting desired, but not required.
