Assistant Division Counsel
The candidate supports Division Counsel and Deputy Division Counsel providing legal advice to the School Board and attend meetings as needed. Advises the firm Division Superintendent, Superintendent's staff, and other instructional and support staff regarding legal issues primarily pertaining to the procurement, leasing, acquisition, and disposition of real property, including associated environmental matters. Works closely with and supports the Chief Operations Officer and staff regarding the development and construction of school facilities, including legal work related to real estate transactions, preparing and reviewing leases and contracts, reviewing plats and engineering plans, analyzing title reports, clearing title, negotiating transactions, advising staff and elected officials, and other duties as assigned. Reviews and drafts legal documents, contracts/agreements, and MOUs required in the operation of the school division and renders opinions relative to the substance, form, and propriety of such documents, contracts/agreements including the drafting, negotiation, and interpretation of contracts including purchases subject to the VPPA. Ability to liaise with the County Attorney’s office and the Board of County Supervisors on matters affecting the planning/zoning of land for school facilities and to attend BOCS and other government meetings related to the same. Assists Division Counsel in the oversight of outside counsel and related legal matters. Experience with other facets of school law, including government purchasing, FOIA, FERPA, state and federal litigation affecting public schools, family law, and child custody a significant plus. Ensures compliance with federal and state laws and interprets laws, ruling, and regulations. Recommends changes in School Board policies and regulations to ensure compliance with applicable federal and state laws and Virginia Department of Education regulations. Coordinates with staff to develop legislation, policies, and other legal documents which promote the interests of the School Division. Provides advice regarding the School Division's policy positions. Assists in the preparation of budget expenditures, amounts to be allocated, and amendments thereto when necessary for the effective operations of the Office of the Division Counsel. Assists with the annual report of legal services provided by the Division Counsel to the School Board and quarterly reports on legal costs. Reviews and provides legal clearance for regulations, agreements, materials, and other documents submitted to the School Board and firm's entities. Provides representation and attends meetings of School Board and Superintendent’s advisory committees as required. Interacts with opposing counsel and/or local government attorneys. Conducts legal research, gathers evidence, and takes other action as necessary to defend or initiate legal action in state and federal courts. Coordinates and provides in-service training/professional development on legal matters which pertain to the overall administration of the School Division. Provides office oversight and assists with the provision of legal services in the absence of the Division Counsel and Deputy Division Counsel. Expertise in real estate, land use, and public contracting strongly preferred. Proficiency in drafting contracts and real-estate related documents. Personal and professional integrity. Proficiency in researching, writing, and public speaking. Ability to supervise the work of others. Ability to work collaboratively with attorneys, support staff, and outside counsel; and Ability to develop effective working relationships with the School Board, Superintendent, Executive Cabinet, and community and governmental leaders critical. Juris Doctorate degree from an accredited law school.
