Job Overview: A law firm in Portland, OR is seeking a Senior Advertising Marketing and Promotions Attorney to join its team. The ideal candidate will possess extensive experience in advertising law, consumer protection law, and marketing transactions. The role requires a high degree of attention to detail, strong legal writing and communication skills, and the ability to work effectively in a collaborative environment. Experience in a large or medium law firm setting is preferred.

Duties and Responsibilities:

• Draft and negotiate agreements related to advertising and marketing, including ad agency, influencer, celebrity endorsement, sponsorship, online media buying, and other promotional deals.
• Review and analyze advertising copy for compliance with false advertising laws, claim substantiation, intellectual property (IP) rights, and right of publicity issues.
• Provide counsel on compliance with contest and sweepstakes regulations.
• Advise on price advertising and recurring subscription program compliance.
• Offer guidance on loyalty and rewards programs.
• Address issues related to false advertising, unfair competition, and National Advertising Division disputes.
• Collaborate with internal teams to ensure alignment on legal matters related to advertising and marketing.

Requirements:

• Juris Doctor (JD) degree from an accredited law school.
• Admission to the Bar in the state of Oregon.
• Substantial experience in advertising law, consumer protection law, and marketing transactions.
• Proven track record of drafting and negotiating complex marketing agreements.
• Experience with false advertising, unfair competition, and National Advertising Division disputes is a plus.

Certifications:

• Active Bar membership in the state of Oregon.
