Legal Counsel

The candidate creates and processes contracts with the State of Michigan, vendors, providers, and other related organizations or entities. Negotiates and drafts contracts and commercial transactions. Provides legal analysis and answers complex legal questions regarding the Freedom of Information Act (FOIA), the Open Meetings Act (OMA), health law issues, HIPPA, administrative law issues, employment law issues, privacy issues, litigation, and any other necessary legal matters. Serves as a resource for legal matters involving Medicaid, Medicare, and Dual-Eligible behavioral health programs including Medicaid Waiver matters. Serves as a resource for the interpretation and application of the Michigan Mental Health Code including matters involving recipient’s rights. Reviews and drafts direct service provider, sub-recipient, professional services, and independent contractor agreements. Serves as a resource for Federal, State, and Local legislative and regulatory-related matters and may directly interact with state and federal agencies, including contract negations with the aforementioned parties. Analyzes legislative and regulatory requirements and assists DWIHN in their implementation. Manages complex projects and coordinates work assignments with the legal staff. Serves as a resource for management throughout the organization with respect to legal issues or concerns as they arise, including issues related to member services. Supports all aspects of PIHP and CMHSP operations, which may include provider contracting, provider disputes, provider and member appeals, claim investigations, or employer group contract issues. Serves as a resource for management throughout the organization and the provider network with respect to federal and state privacy laws and regulations, including HIPAA, business associate’s agreements, and breach notification obligations. Performs other duties as assigned. Should have knowledge of fundamental law, research procedures, preparation of pretrial briefs and arguments, and trial of complex cases; knowledge of litigation and corporate transaction practices; knowledge of the Freedom of Information Act (FOIA), the Open Meetings Act (OMA), health law issues, HIPPA, administrative law issues, employment law issues, privacy issues, litigation, and other related legal matters; knowledge of Medicaid, Medicare, and Dual-Eligible behavioral health programs including Medicaid Waiver matters; knowledge of DWIHN policies, procedures, and practices; knowledge of the DWIHN provider network and community resources; knowledge of the Michigan Mental Health Code; knowledge of MDHHS policies, rules, regulations, and procedures; knowledge of Federal policies, rules, regulations, and procedures as it relates to DWIHN; knowledge of compliance standards. Must be a member of the State Bar of Michigan with admission to practice before the Michigan Supreme Court. A valid State of Michigan Driver’s License with a safe and acceptable driving record.
