Associate General Counsel
Responsibilities: Gives upon request and direction of the General Counsel legal opinions and advice concerning Board of Education policies, practices, and general legal principles affecting the public school system. Gives upon request and direction of the General Counsel legal interpretations concerning administrative rules and regulations affecting public school affairs. Attends Board of Education meetings. Performs to the extent requested services as a research specialist in the completion of assigned tasks relating to public school affairs. Examines legal instruments, contracts, opinions prepared by other attorneys, and court decisions, and subsequently advises the Board of Education. Acts as attorney-agent in real estate transactions as directed by the General Counsel. Gathers evidence at the direction of the General Counsel for the Board of Education or the school district to be used in school business, to formulate defense, or to initiate legal action. Represents at the direction of the General Counsel the Board of Education and the school district in court and before quasi-judicial or administrative agencies of government as directed by the General Counsel. Acts as counsel upon request and direction of the General Counsel as directed in the event of suits concerning school affairs. Represents the school district in appeal cases to higher courts when directed by the General Counsel. Works with special legal counsel as directed by the General Counsel. Is knowledgeable of and responsible for legal work being performed in behalf of the Board as directed by the General Counsel. Review contracts and agreements as directed by the General Counsel from all areas of the district. Drafts contracts and agreements as directed by the General Counsel from all areas of the district. Reviews legislation as directed by the General Counsel before and after passage. Handles student suspension and expulsion matters as directed by the General Counsel. Interprets state statutes and federal statutes and regulations as applied to school districts. Torts Claims Act and claims against the district as directed by the General Counsel. Reviews family law matters pertaining to parental contact with students at school, clarification of custodial issues for staff pertaining to students as directed by the General Counsel. Reviews subpoenas as directed by the General Counsel. Receives and responds to Department of Education Office of Civil Rights (OCR) complaints as directed by the General Counsel. Receives and responds to complaints filed with the Kansas Human Rights Commission and Equal Employment Opportunity Commission or assign to outside counsel as directed by the General Counsel. Reviews domestic orders as directed by the General Counsel. Responsible for real estate law (acquisition, sale, etc.), special education law (due process), Section 504 law, Americans with Disabilities Act issues, employment law, civil rights issues, health care law, technology law, open records law (Kansas Open Records Act), construction law (contracts and claims), Professional Negotiations Act law, Title IX law, first amendment issues (religion and speech), constitutional law, policy drafts (from a legal standpoint), garnishment law, IRS code as applied to school districts, criminal trespass (Parent bans), FERPA, FMLA, worker’s compensation, Employer-Employee Relations Act, and land use law as directed by the General Counsel.
