Counsel Environment, Health, & Safety
The candidate will be advising and representing the Company on complex environmental compliance and enforcement matters, including those arising under federal and state environmental laws and regulations on air emissions, wastewater, hazardous and solid waste, hazardous materials, and storm water. Advising of health and safety legal matters – typically those arising from alleged safety violations. Advising business counsel and management on regulatory enforcement matters as well as EHS considerations in transactions. Partnering with Company merger, acquisition, and transactional attorneys and internal stakeholders to advise on strategy and to prepare and negotiate EHS provisions of transactional documents. Analyzing issues, developing strategy, and managing complex site remediation-related matters and activities including state and federal Superfund sites. Managing outside counsel retained to support the Company’s environmental legal needs. Responding to emergency crisis calls involving environmental and health and safety incidents. Advising on potential liability and ramifications of promulgated or emerging rules and statutes. Preparing, reviewing, negotiating, and advising on environmental claims arising from contractual obligations. Contributing to cross-functional or departmental projects and teams. Investigating environmental and health and safety compliance issues at manufacturing facilities across the US.. J.D. degree from an accredited law school is required. Should have 5+ years of experience in environmental litigation and regulatory compliance counseling for a large law firm or corporation. Experience handling complex cases involving Clean Water Act and Clean Air Act for large companies is required. Excellent knowledge of and experience with major federal environmental laws and regulations is required. Experience providing environmental regulatory compliance advice to industrial manufacturing clients is required. Experience with multi-party site cleanup litigation is required. OSHA experience is preferred.
