Duties: Handling all aspects of the Department of Education’s (DOE) compliance plan, in accordance with the 2009 amendment to the School Governance Law. Will perform work related to the development and implementation of reporting requirements for the agency-wide strategic diversity plan and will ensure department-wide compliance with Equal Employment Opportunity (EEO) laws and policies. Performs related work. Reports to: Diversity Management Unit Chief. Direct Reports: Equal Rights Diversity Specialists, and administrative/clerical support staff. Acts as a liaison with executives within the DOE and with City, State, and Federal agencies regarding matters relating to the strategic diversity plan. Develop, draft, and implement a strategic agency-wide diversity plan, including diversity initiatives designed to ensure compliance with the 2009 amendment to the School Governance Law. Update the DOE’s diversity plan on an annual basis. Examine the participation of Minority and Women-Owned Business Enterprises (MWBE’s) in the procurement process; create and implement initiatives to increase the participation of MWBE’s in order to achieve compliance with the School Governance Law and applicable MWBE regulations/requirements. Receives, processes, and investigates complaints of discrimination and sexual harassment from students, staff, parents and third parties. Conducts interviews of all relevant parties to a complaint, including, but not limited to, the complainant, the respondent, witnesses, students, parents of students, and staff members. School-based investigations may require travel to schools in any of the five boroughs. Interviews complainants, converting oral allegations into written form. Analyzes complaints, develops investigative plans, conducts fact-finding, reviews documents, conducts related legal research, prepares any related correspondence, drafts and submits confidential reports containing investigative findings. Reviews and edits confidential reports prepared by OEO investigators. Ensure adherence to MWBE requirements in grant applications by providing guidance to DOE offices on best practices for making good faith efforts to locate and solicit MWBE vendors. Prepare annual reports on the role of MWBE’s in the procurement process. Review and analyze workplace data and statistics. Develop and draft diversity related rules, regulations and policies for the DOE. Conduct research and prepare legal memoranda related to the strategic diversity plan and general EEO matters. Provide advice and counsel to the Executive Director on legal issues related to the strategic diversity plan and EEO matters. Analyze and report on the effects of City, State, and Federal legislation and applicable case law pertaining to diversity issues. May serve as the supervisor of the Diversity Management Unit, reviewing work of the unit’s legal staff to ensure compliance with deadlines on preparing reports and summaries, as needed. Disseminate and implement rules, regulations, procedures and guidelines designed to further the DOE’s strategic diversity plan. Act as a liaison with various external agencies, including the Equal Employment Practices Commission, Corporation Counsel, and the Department of Citywide Administrative Services (DCAS), by providing statistical data on Equal Opportunity complaints and discrimination trends, department initiatives, complaint investigation information, and testimonial evidence. Provide diversity training, technical assistance and support in all matters concerning diversity at the DOE.
