Procurement Contracting Attorney
The candidate acts as legal counsel to the Procurement Services Group. Will be responsible for assuring that contracts entered into by the Department are legally binding, accurately reflect agreement terms, conform with state and federal law, and satisfy applicable procurement policies and procedures. The position requires researching contract law, federal grant administration, interagency and intergovernmental agreements, rights of privacy, technology ownership, and public service obligations. The position is exposed to the full breadth of responsibilities and services that are administered by the firm. Reviewing public contracting documents, drafting grant award agreements, finalizing service contracts, negotiating details of technology licenses, and memorializing financial and service relationships between the Department and public, private, non-profit, and independent contractors are all within the scope of the position. Additional responsibilities include advising program managers and contract administrators during contract performance, revising and updating agreement templates, evaluating and educating staff regarding legislative and regulatory developments, and providing legal support for a variety of other Department activities. Close collaboration with knowledgeable and experienced procurement contracting staff enhances overall efficiency. Should have 3 years of experience as an attorney practicing law and providing legal services such as preparing and trying cases, advising clients, and/or interpreting laws or administrative policies. In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar. Preferred: Experience with contract law; federal, block, or state grants; software licensing agreements; Medicaid programs; and/or public health is required. must have Knowledge of: State and federal constitutional, statutory, and regulatory provisions pertinent to agency programs; bidding and contracting processes; grant documentation. Skill in: preparing summaries, legal analyses, legal conclusions, and memoranda; negotiating and communicating with others sufficient to identify and implement DHHS policies and positions; thinking critically to resolve practical issues arising from a broad array of contracts, grants, and relationships. Ability to: interpret and apply statutes, case law, decisions of judicial/administrative hearings, and administrative rules and policies on a variety of legal issues; effectively communicate and interact with legal associates, other government employees, and the public; conduct legal research; formulate legal opinions and recommendations based on legal research; identify critical elements of legal questions or issues; and use a computer for word processing and research.
