Assistant Public Defender
The candidate will perform professional legal work involving responsibility for assisting in the representation of indigent defendants as assigned by the Public Defender. The work involves responsibility for participating in the investigation, preparation, conduct and appearance in various court and legal proceedings involving felony and misdemeanor crimes as well as violations. Also represents respondents financially unable to obtain counsel in family court and surrogate court proceedings. The work is performed under the general supervision of the Public Defender. Supervision is exercised over the work of clerical subordinates. Typical Work Activities (illustrative only): Prepares cases for hearings and trials, prepares briefs, secures evidence and conducts investigations; Represents and counsels defendants at every stage of proceedings following arrest; Represents clients in family and surrogate court proceedings; Initiates such proceedings as are necessary to protect the rights of the accused; Corresponds with referral and intervention social agencies to arrange for client counseling and/or in-patient treatment as component of negotiated dispositions; Confers with defendants, witnesses, law enforcement officers, judges and District Attorneys concerning individual cases; Prepares and processes warranted appeals; Supervises assigned clerical staff; Prepares records and reports related to the work. Must be able to work nights and weekends as needed. Thorough knowledge of court procedures and the rules of evidence; good knowledge of the principles and practices of criminal law; good knowledge of the procedures of filing and processing legal appeals; good knowledge of legal research practices, procedures and techniques; skill in the preparation of briefs and in the presentation of a defense before a jury; ability to efficiently gather facts by interview, research and investigation; ability to analyze, appraise and apply legal principles, facts and precedent to legal problems; ability to express arguments of the law, clearly and concisely; ability to cross examine witnesses and negotiate settlement of cases; ability to communicate effectively, both orally and in writing; ability to establish and maintain effective working relationships with other attorneys, agencies and County officials; initiative; good judgment; capable of performing the essential job functions of the position with or without reasonable accommodations. Possession of a license to practice law in New York State.
