Attorney III
Duties : Responsible for providing legal advice to all Department programs regarding various legal issues involving or affecting the Department. Provides legal support on matters related to administrative, civil, and criminal enforcement actions. Reviews inspection reports, penalty assessments, and other legal documents. Drafts administrative orders and civil complaints. Researches legal issues and provides written and oral advice to the Director, Deputy Directors, and Department staff on the interpretation and implementation of the statutes and regulations. Reviews documents for legal consistency with federal and state statutory and regulatory requirements. Represents the Department in administrative proceedings. Assists in drafting inspection warrants and information requests. Assists in criminal investigations. Conducts or participates in settlement negotiations and drafts case settlement documents. Develops and updates Department enforcement policies and procedures in collaboration with other Department staff. Reviews and analyzes historical Department policies and procedures for present applicability. Reviews and analyzes policies, procedures, and guidance from other agencies, such as the California Environmental Protection Agency (Cal/EPA) and the United States Environmental Protection Agency (U.S. EPA) for consistency with the Department's policies and procedures. Drafts policies, procedures, guidance, and legal documents outlining and reflecting the Department's enforcement policies and procedures. Responds to legal questions from Department staff regarding the Department's policies and procedures. Develops and conducts training on enforcement policies, procedures, guidance and model documents. Drafts litigation referrals and ensures that all supporting documents are made available to the Attorney General's Office. Coordinates with the Attorney General's Office on Department litigation matters. Assists the Attorney General's Office with interpretation of statutes, regulations, policies and procedures regarding the Department's authority, and roles and responsibilities. Reviews complaints, motions, and other pleadings. Assists in discovery and trial, including witness and expert preparation. Represents Department employees subpoenaed for deposition and trial testimony. Reviews PRA requests, other public, and legislative inquiries, and the Department’s responses. Provides legal support and advice to Department staff on record requests about sites and issues implicated in anticipated or ongoing litigation and the appropriate course of action. Uses knowledge of PRA requirements to determine whether records are privileged or otherwise exempt from disclosure. Reviews and analyzes proposed federal and state legislation and regulations pertaining to permitting and enforcement issues. Participates in meetings with environmental, industry, governmental, and other groups regarding proposed legislation and regulations. Negotiates with lobbyists and legislative staff regarding language of proposed legislation and regulations affecting Department programs. Performs administrative duties including, but not limited to: adheres to Department policies, rules, and procedures, submits administrative requests including leave, overtime, travel, and training in a timely and appropriate manner; accurately reports time in the Daily Log system and submits timesheets by the due date. Performs other related duties as required to support the functions of OLC including, but not limited to, reviews and comments on departmental guidance, policies and procedures; attends job-related departmental meetings; participates in assigned special projects and work groups; and maintaining project files.
