Assistant General Counsel

The candidate provides legal counsel and guidance to the officers of the institution and management on all legal matters relevant to the large, private, for-profit, higher education institution, including compliance, and general business law, policies, procedures, rules, and regulations, and laws pertaining to education, students, real estate transactions, contracts and grants, tax matters, worker's compensation, liability and insurance matters, private monies and purchases, affirmative action, and other state and federal laws and regulations. Reporting directly to the General Counsel and working in a multi-faceted, multi-location academic and administration setting is responsible for the legal interpretation, and application of all policies for American Career College, West Coast University, sand Administration consistent with federal, state and other regulatory agencies, including the Department of Education and accrediting bodies. Research state, federal and local laws, regulations, administrative and court decisions and makes recommendations on new or changes to policies to remain current and in compliance. Collaborates and assists all the organization by giving advice/guidance regarding legal matters, internal investigations and responds to and manages the organization's position and correspondence with outside legal and non-legal inquiries, complaints, and legal matters. Collaborates with all ACC, WCU, Shared Services departments and campuses. Collaborates with Compliance, Officers and Directors to manage risk and advise on regulatory and legal issues. Provides counsel and advice related to private, proprietary, higher education laws and regulations, including the interpretation of statute and regulation and the development of implementation plans for new and changing laws. Provides regular counsel and advice regarding compliance with federal and state statutes and regulations affecting institutions of higher education. Promotes compliance with applicable laws and regulations related to higher education and relationships with customers, competitors and vendors. Provide analysis of proposed regulations and/or legislation and maintain awareness of activities that have the potential to impact the institution from both a state and federal regulatory level. Drafts, reviews, and approves policies and procedures, regulations, bylaws, and other legal documents. Reviews contracts and other legal documents; researches legal issues and recommends revisions as necessary. Coordinates and manages the contract review process to ensure all requisite parties review and accept contract terms prior to execution. Updates and/or assists with the creation of new policies for both American Career College and West Coast University in compliance with all federal and state laws and organizational policies, procedures and/or practices. Assists in the supervision of outside counsel and facilitates the advice provided by outside counsel who possess special regulatory expertise. Provides guidance/assistance on internal investigations and other matters that could lead to legal action. Conducts job responsibilities in accordance with the standards set out in the Company's Code of Ethical Conduct, Compliance Agreement, Sexual Harassment Policy or any of its policies and procedures, applicable federal and states laws, and applicable professional standards. Maintains regular and timely attendance, reports to work as scheduled and assures time worked and/or time-off is recorded properly. Maintains established department policies, procedures and attends in-services and other required meetings. Maintains confidentiality of all student, associate, and/or company information as required. Exercises care, proper use and maintenance of department equipment and supplies and identifies unsafe conditions and makes appropriate adjustments. Maintains order, cleanliness and safety at work. May perform other duties as assigned. A Juris Doctorate from an ASA accredited law school is needed. Should be licensed to practice law in California and in good standing with the California State Bar. Should have 5+ years' experience working in a heavily regulated sector, with demonstrative experience of working with state and federal regulations. Experience developing and implementing strategy for implementing compliance in response to new laws and regulations. Passion for higher education and healthcare advocacy, with experience within higher education strongly preferred. Strong analytic and communication skills, able to articulate complex concepts in a concise and compelling manner.
