General Council and Executive Vice President
Duties: Ensure all privacy practices adhere to regulatory and compliance standards. Identify potential areas of privacy and security vulnerability and advise on risk avoidance and mitigation. Develop and implement corrective action plans for resolution of problematic issues, and provide general guidance on how to avoid similar situations in the future. Help in establishing and maintaining an effective and fully compliant internal control system with federal, state, and local statutes and regulations. Anticipate and guard against legal risks facing the company. Identify, analyze, and report on important legislative and regulatory developments. Provide legal counsel on issues arising from actual or anticipated lawsuits, and to prevent future ones. Develop and recommend company policy and position on legal issues. Conduct and coordinate research into a variety of legal issues. Represent in various legal proceedings. Write, review, and edit reports, opinions, correspondence, contracts, and other legal documents. Write and administer complex vendor, client, and employment contracts as needed. Respond to government investigations and queries as the principal point of contact. Manage external counsel and general litigation; provide input on the decision whether to send matters to outside counsel and assist in the oversight of outside counsel as necessary. Maintain requisite knowledge and skill of Medicare compliance, staying abreast of changes in the law and engage in continuing study and education. Function as a strategic business advisor for all issues related to Medicare and HIPAA Compliance.
