Civil Litigation Trial Attorney
The candidate handles the investigation and prosecution of civil tort claims seeking recovery of damages caused by injuries to the employees of the Company's insured. Prosecution of civil litigation tort actions mostly involving product liability, general negligence and premises liability causes of action. Handles all aspects of litigation, including discovery and depositions, analyzes records and testimony, related motion practice and internal litigation reports. Represents the Company in appearances at court hearings and conferences; prepares and files related internal reports. Researches and prepares complex pleadings for cases in state and federal civil courts. Provides advice, training, and recommendations on claim handling strategies and tactics to relating to the Company’s civil litigation recovery efforts. Performs legal research at all levels, from initially advising clients through the appellate proceedings. Acts as inter-departmental training leader regarding the Company’s civil litigation practice and recovery efforts. May assist in training other attorneys and staff relating to civil litigation and tort recovery matters. Applies principles of logical thinking to define problems, collect data, establish facts and draw valid conclusions. Responds positively to direction and critique of performance. Consistently maintains professional and appropriate demeanor. Performs other duties as assigned. High School Diploma or equivalent required. A Juris Doctorate Law school graduate and member in good standing of the California State Bar required. Should have 5+ years of experience as a Trial/Litigation Attorney on civil litigation matters, with plaintiff’s litigation experience preferred. Lead counsel experience in jury trials to verdict is required, with additional experience as lead and/or second-chair counsel in jury or court trials preferred. Preferred Ability to communicate both orally and in writing, in an articulate, persuasive, precise and professional manner. Experience with training small groups in current legal practices and procedures in the field of subrogation. Ability to lift legal files, including documents and exhibits, up to a weight of 30 pounds. Must be willing and able to travel extensively using all means of public transportation, as well as capable of prolonged automobile driving, in excess of three hours a day, to widely dispersed venues.
