Legal Counsel
The candidate will be responsible for providing advice on advertising, offers and promotions, drafting terms of use, and assisting in compliance matters, as well as drafting and negotiating commercial contracts. Key areas include federal regulation of financial institutions with particular focus on Regulation E, Privacy, the Prepaid Account Rule, UDAAP, state and federal regulation of money services businesses and related emerging payments issues. Will report directly to the Vice President, Regulatory Counsel and it will be part of the Legal Department based at the company’s corporate headquarters in Austin, Texas. Review consumer-facing materials and advise marketing clients directly on legal and regulatory requirements related to marketing, promotions and sweepstakes. Remain up-to-date on relevant financial services, payments, consumer protection, advertising and privacy laws and regulations to provide sound regulatory and compliance advice. Draft terms of use, policies, disclosures and other related implementation and user experience materials. Interact directly with the company’s issuing banks and third-party distributors on legal and compliance issues. Support legal team on transactional matters with regulatory implications, including commercial contracts and strategic transactions. Draft and negotiate commercial contracts. Prefer financial services regulatory experience; will consider all levels of experience. Experience drafting contracts. Strong interpersonal and exceptional written and verbal communication skills. Demonstrated commitment to providing the highest quality legal services. Practice experience in public sector (financial institutions, regulatory agency or similar) a plus. Juris Doctor from an accredited law school. Admission to one or more state bar associations.
