Senior Counsel, Patent Litigation
The candidate will be responsible for producing quality support on a range of projects (with support from line manager) which follows best practices – familiar with and follows departmental guidance. Develops relationships with and work very close with and alongside external counsel, including attendance at depositions, hearing, trials, etc. to execute patent litigation strategy. Provides legal advice and influence clients to mitigate or avert legal risks, by providing creative, strategic IP advice on patent litigations or patent litigation-related projects, with the support of Line Manager. Understands how the interplay between patents and non-patent exclusivities impacts litigation strategies and preparations. Considers the competitive situation, prior art, GSK’s business and commercial needs, advising on appropriate strategy to manage IP risk while maximizing business benefit. Provides client advice that is strategic, thoughtful and clear on IP litigation-related matters of relatively high complexity and impact, has clear and concise communication skills and the ability to translate complex matters into simple terms digestible by a wide variety of audiences. With support of line manager makes connections between different client groups and within the department as needed due to familiarity with key roles and people within the business as well as broad GSK business structure and needs. Responsible for current awareness of developing case law, able to apply same to litigations, responsible for ensuring the department is kept up to date with developments through e.g., current awareness meetings. U.S. Law Degree (Juris Doctorate) from a national law school. Admission to any State Bar in the United States. Should have 4+ years of hands-on experience with complex patent litigations in the biotechnology and/ or pharmaceutical industries. Law firm experience is highly preferred. Ability to work in a highly team-oriented environment. Demonstrated experience with international IP litigations a strong plus. A creative and strategic approach to the development and enforcement of IP. Ability to communicate competently and confidently with R&D clients, business partners, and senior management. Undergraduate degree in a life science-related field (e.g. biology, immunology, biochemistry, or related sciences), or comparable relevant work experience. Admitted to practice in front of the U.S. Patent and Trademark Office (USPTO bar admission).
