The candidate will provide legal counsel to the Company with respect to its operations and general legal affairs. Will assist with drafting, review and negotiation of contracts. provides analysis and legal advice on issues involving the Company’s collections’ and loan recovery activities. provides analysis and legal advice regarding regulatory and compliance issues, especially licensing and registrations and the Company’s vendor management program. ensures that appropriate staff are made aware of and educated regarding applicable laws and regulations. and ensures that policies and procedures are in accordance with applicable laws and regulations. Draft, review and negotiate commercial contracts, including non-disclosure agreements, consulting agreements, supply agreements and vendor agreements. Provide analysis and legal advice on various regulatory/compliance issues and matters, including licensing and registrations. Conduct and/or coordinate analyses of business function processes and policies against governing laws and regulations to determine gaps in compliance and help draft new policies and procedures. Assist the Loan Operations staff in managing customer complaints and other escalated issues in a manner that mitigates the risk faced by the Company. Proactively identify, review monitor applicable laws and regulations affecting the student loan industry, such as the Fair Credit Reporting Act (FCRA), Equal Credit Opportunity Act (ECOA), Truth in Lending Act (TLA), Fair Debt Collection Practices Act (FDCPA), Unfair Deceptive or Abusive Acts or Practices Act (UDAAP), Service Member Civil Relief Act (SCRA), Bankruptcy Act, Internal Revenue Code and Privacy Laws.Assist the Collections and Loan Recovery staff in managing the Company’s relationship with its collection agencies and responding to day-to-day regulatory and legal issues relating to the Company’s collections and loan recovery activity. Develop and conduct training regarding laws and regulations that impact the Company. Assist in oversight of the Company’s vendor management program to ensure that third party vendors comply with contractual requirements, privacy and security laws, and federal regulatory requirements relating to the student loan industry, including FFELP, Higher Education Act (HEA), FCRA, ECOA, TLA, FECPA, UDDAP and SCRA. Conduct and/or coordinate investigation of facts involving potential litigation and determine/pursue actions needed to resolve such matters without litigation. Assist in identifying, developing and implementing process and technological changes to increase the efficiency of the Company’s legal affairs-related activities. And Other duties as assigned.
