Administrative Law Judge III
Duties: Leads the Policy and Bureau’s Specialists in determining whether to grant or deny requests for rehearings in the CalWORKS, CalFRESH, IHSS, Foster Care and CAPI programs; and, analyzes and determines the most challenging and complex rehearing requests in these program areas. Serves as the Division’s expert on the CalWORKS, CalFRESH, IHSS, Foster Care and CAPI programs. Reviews, develops and disseminates significant, complex and sensitive information/direction regarding innovative changes in law, regulation and policy. Heads up the review and implementation of SHD’s role in new and proposed regulations, legislation, program letters, All County Letters (ACL), All County Information Notices (ACIN) in these programs; and guides SHD’s ALJs in managing projects for these programs. Such activities include assisting with training and mentoring ALJs, monitoring the quality of hearings and decisions, and directing special projects to enhance efficiency and due process in these program areas. Serves as a recognized expert in liaising with Legal staff, CDSS Executive staff, the legislature, high level governor appointees, constitutional officers, and the public in addressing CalWORKS, CalFRESH, IHSS, Foster Care and CAPI program related issues at SHD. Participates in Departmental and external stakeholder communications regarding these programs. Works with the ALJ II, Supervisor in consultations with counties and advocates on CalWORKS, CalFRESH, IHSS, Foster Care and CAPI program issues and concerns. Coordinates responses to inquiries concerning analyses of proposed bills and/or amendments to regulations. Provides expertise in developing new laws and policies. Assists with leading training for ALJ Is and ALJ II, Specialists as well as county and advocate staff on program and hearing procedures, policies and in the development of training modules. Hears the most difficult and sensitive cases in CalWORKS, CalFRESH, IHSS, Foster Care and CAPI programs. Provides the Chief Administrative Law Judge (CALJ) and ALJ II, Supervisor sufficient metrics to identify and communicate the progress for special calendars. Reviews and submits recommendations to the CALJ on the most significant, complex and sensitive hearings in the CalWORKS, CalFRESH, IHSS, Foster Care and CAPI programs. Conducts complex rehearings on these cases, and submits recommended determinations for CALJ approval. Writes decisions in a timely manner and provides precedential decisions in cases in which no current California precedent is available. Conducts exhaustive legal analysis and interpretations for hearings that will set a new legal precedent relating to the CalWORKS, CalFRESH, IHSS, Foster Care and CAPI programs. Perform other duties as assigned by the CALJ and/or ALJ II, Supervisor. Under general direction of the Constitutional Officer, exempt appointee of the Governor, the Departmental Director, or their designees, incumbents in the Administrative Law Judge (ALJ) III classification serve the public by presiding over quasi-judicial hearings on the most difficult or sensitive matters as provided under the Administrative Procedures Act and other applicable statutes. Presides over hearings for various state and other public agencies in connection with the issuance, renewal, suspension, or revocation of licenses and other matters referred for hearing and prepares decisions, orders and/or opinions from transcripts and evidence submitted containing findings of fact, conclusions of law, and recommended actions; submits decisions, orders and/or opinions to the appropriate agency; conducts hearings on the most difficult or sensitive cases; controls the course of the hearing, and secures its reasonable expedition and orderly conduct throughout; administers oaths; instructs participants at hearings as to their rights; questions witnesses; rules on the relevancy or admissibility of evidence; issues subpoenas for the attendance of witnesses or the production of necessary books, papers, documents, or other evidence; receives and reviews evidence in written form; examines testimony taken by deposition; prepares reports to supplement findings and recommendations; certifies to official acts of an agency; forwards necessary information to the proper parties when appeals are carried to higher authorities; and/or advises or consults with Hearing Officers on points of law, findings of fact, decisions, and methods of operation. Hearings assigned typically will involve the most complex or technical areas of law, fact patterns, testimony, or witnesses who have a high level of expertise and specialization. Hearings may have high levels of public, political, or media Interest, and the potential for high monetary award.
