Hearing Officer
The candidate work for Division of Human Rights conducts formal public hearings in cases of discrimination and discriminatory practices in employment, housing, public accommodations or other conditions defined in the Human Rights Law where the agency has found probable cause for complaint and where the respondent fails to conciliate or the complainant objects to the terms of reconciliation. Considers questions of fact and law brought forth at hearing, prepares reports of findings and conclusions, makes recommendations in the form of an order for issuance by the Commissioner of Human Rights to dismiss the case or to require the respondent to cease from any unlawful discriminatory practice indicated during the hearing and to require the respondent to take appropriate corrective action; may award compensatory damages to the complainant; subpoenas witnesses; receives testimony under oath and documentary evidence; examines witnesses; rules on objections to the admissibility of evidence and to the conduct of the hearing; evaluates the records of the hearing; researches and determines the pertinent rules of law. Must be duly licensed and authorized to practice law as an attorney under the laws of the State of New York and 4 years of subsequent full-time legal experience engaged in the promotion and protection of human rights or civil rights under the New York State Human Rights Law (or related federal, state or local anti-discrimination laws), and involved in the conduct of trials or adversarial proceedings, judicial or quasi-judicial, before a court of record or governmental agency.
