Job Overview
The selected candidate will handle a variety of insolvency-focused matters, including Chapter 7 and Chapter 11 cases, under the guidance of senior partners.
This position blends transactional and courtroom responsibilities: counseling debtors or creditors, drafting pleadings, and appearing in hearings when needed.
A collaborative mindset and willingness to learn are essential, as the attorney will work closely with colleagues on complex financial restructurings and contested matters.
Key Duties
Assist with case intake: gather client information, review financial documents, and prepare initial filings such as petitions and schedules.
Draft motion practice and response memoranda in bankruptcy adversary proceedings, contested confirmations, and relief-from-stay hearings.
Conduct legal research on bankruptcy code provisions, local rules, and relevant case law to support senior attorneys’ arguments.
Coordinate with trustees, creditors’ committees, and other parties in interest to negotiate restructurings, reaffirmation agreements, and settlement terms.
Attend and participate in creditor meetings, status conferences, and confirmation hearings, providing real-time support to lead counsel.
Perform due diligence on debtor assets, including real property, intellectual property, and accounts receivable, to identify recovery possibilities.
Prepare and manage schedules of assets and liabilities, statements of financial affairs, and other core bankruptcy documents.
Monitor deadlines and court-mandated timelines, ensuring all filings comply with Federal Rules of Bankruptcy Procedure and local district requirements.
Collaborate with support staff to assemble exhibits, prepare witness outlines, and assemble pleadings for trial or contested matters.
Support business development by assisting in drafting client alerts, newsletters, and presentations on emerging trends in chapter-related litigation and restructuring strategies.
Experience & Requirements
1–6 years of experience practicing bankruptcy, financial restructuring, or related litigation.
Admission to the North Carolina Bar (or eligibility to transfer under reciprocity).
Comfort with both transactional elements (e.g., negotiating with creditors, drafting reorganization plans) and adversarial proceedings (e.g., contested motions, adversary complaints).
Proficiency in legal research platforms (e.g., Westlaw, LexisNexis) and familiarity with electronic court filing systems (CM/ECF).
Excellent drafting abilities, with capacity to produce clear, concise motions, memoranda, and restructuring plans.
Strong organizational skills and attention to detail, capable of managing multiple files and deadlines.
Ability to communicate complex financial and legal concepts to clients, trustees, and co-counsel with clarity and professionalism.
Collaborative attitude, willing to learn from senior attorneys and contribute to a team-driven workflow.
A proactive approach: where litigation experience exists, demonstrate skill in depositions, discovery disputes, or contested hearings; conversely, bankruptcy-focused candidates should show aptitude for courtroom appearances when required.
Education
Juris Doctor (J.D.) from an accredited law school.
Undergraduate degree in any discipline, ideally demonstrating analytical and writing strengths.
Certifications & Licenses
Active license to practice law in North Carolina.
Federal bankruptcy court admissions preferred (e.g., Eastern or Middle District of North Carolina).
Continuing legal education (CLE) certificates in bankruptcy, debtor-creditor law, or commercial litigation will be viewed favorably.
