Job Overview:
A well-established law firm is looking for a dedicated Foreclosure Associate Attorney to join their growing team. This position will focus on managing and handling all aspects of the non-judicial foreclosure process, litigation stemming from replevin, pre-litigation cases, and title clearance. The ideal candidate will have excellent legal and communication skills, the ability to manage a high volume of cases, and a strong foundation in creditors' rights law.

Duties and Responsibilities:

  • Oversee the entire non-judicial foreclosure process from referral to sale
  • Manage litigation arising from the replevin process
  • Handle pre-litigation cases and assist in title clearance for real property
  • Provide case analysis and strategic advice to clients
  • Draft and file court pleadings and motions
  • Represent clients at hearings, mediations, and settlement conferences
  • Make court appearances as needed
  • Perform other related duties as assigned

Requirements:

  • Minimum of 1 year of experience in creditors' rights, real estate, or mortgage servicing (preferred)
  • Strong written and verbal communication skills
  • Proficiency with Microsoft Office, particularly Excel
  • Ability to manage multiple projects simultaneously and effectively prioritize tasks
  • Exceptional organizational skills and attention to detail
  • Ability to quickly identify and resolve issues
  • Experience with foreclosure and replevin processes (preferred)
  • Knowledge of consumer protection statutes, including the Fair Debt Collection Practices Act (preferred)
  • Well-versed in the rules of evidence and evidentiary procedures
  • Ability to manage a high caseload with efficiency

Education:

  • Juris Doctorate (JD) from an accredited law school
  • Member of the Texas State Bar (required)

Certifications:

  • Active membership in the Texas State Bar, with all necessary licenses and continuing legal education (CLE) requirements, maintained

Skills:

  • Strong communication and negotiation skills
  • Excellent time management and multitasking capabilities
  • Knowledge of foreclosure and replevin laws
  • Proficient in case management and legal documentation
  • Critical thinking and problem-solving abilities
