Associate Corporate Counsel

The candidate will act as a key legal partner for the sophisticated and multifaceted business units within the Microbiology Division, and member of the Specialty Diagnostics Group Legal team. Provide strategic advice and support related to complex commercial contracts, as well as guidance on RFPs/RFQs, including the drafting, review, and negotiation of contracts. Provide leadership, legal advice, and drive solutions on a range of legal, business and compliance matters, including government contracts, commercial antitrust, marketing, anti-bribery/FCPA, fraud and abuse, US Affordable Care Act, the US Sunshine/Open Payments Act and global equivalents, products liability, and data privacy (US and global). Provide guidance and oversight to marketing, regulatory and commercial teams related to FDA-regulated devices, including understanding and providing guidance of regulatory claims and RUO claims. Provide advice regarding customer and other commercial/business complex disputes, including collections, bankruptcy and contract breaches. Provide training on a range of commercial and compliance matters, including commercial contracts, Healthcare compliance (Anti-Kickback Statute; False Claims Act and Sunshine Laws) and other compliance matters (FDA, FCPA). Provide guidance and support to Contract Management and commercial teams regarding approval processes and policies. Provide legal support to Corporate and Group marketing, communications, procurement and e-commerce organizations, as needed. Lead strategic projects involving cross-functional and cross-divisional teams within business units and legal department to improve business processes.
