A law firm seeks an experienced litigation attorney to join its Special Investigations Unit in Wilmington, DE. This full-time role, engaged through our recruiting services, focuses on defending and prosecuting insurance fraud matters, collaborating with internal investigation teams and senior attorneys to safeguard clients against fraudulent claims.
Duties
Collaborate with special investigations teams to evaluate, defend, and prosecute suspected fraudulent insurance claims
Initiate and manage affirmative actions, including RICO-based litigation, against individuals or entities committing insurance fraud
Develop and implement case strategies for claims arising from bodily injury, uninsured motorist (UM) disputes, trucking and transportation matters, labor law incidents, first-party property breaches, personal injury protection (PIP) disputes, and workers’ compensation issues
Draft and respond to discovery requests, prepare motions, briefs, and other litigation filings in state and federal courts
Conduct depositions, examinations under oath (EUOs), and interviews of witnesses and expert consultants
Represent clients at hearings, mediations, arbitrations, and trials, coordinating with expert witnesses and managing trial logistics
Negotiate settlements and draft accompanying agreements, ensuring alignment with client objectives
Review assigned files to prioritize tasks, assess risks, and determine optimal resolution strategies
Requirements
Minimum of four years of civil defense litigation experience, preferably with substantial involvement in insurance-related or fraud investigations
Proven ability to develop litigation strategies and lead complex cases from inception through resolution
Strong investigative instincts, with experience analyzing fraud indicators and collaborating with investigative and claims teams
Exceptional legal writing skills, including the preparation of pleadings, motions, and detailed case analyses
Demonstrated proficiency conducting depositions, EUOs, and handling courtroom advocacy in both state and federal jurisdictions
Excellent negotiation abilities to resolve disputes favorably while mitigating exposure
Effective time-management and organizational skills, capable of balancing multiple cases and adjusting priorities in a fast-paced environment
Admission to the Delaware State Bar in good standing
Education
Juris Doctor (J.D.) from an ABA-accredited law school
Solid academic record, preferably with honors or leadership roles (e.g., moot court, law review)
Certifications
Active membership in the Delaware State Bar (required)
Federal court admission (preferred but not mandatory)
